2. Scope of these terms
These Terms and Conditions apply when you make an enquiry, request a quotation, place an order or otherwise purchase goods or services from Squid Ink.
They also apply to your use of this website where relevant.
If you are purchasing as a consumer, nothing in these Terms and Conditions affects any statutory rights that cannot lawfully be excluded or restricted.
3. Enquiries and quotations
You may contact us for information, compatibility advice, product availability or a quotation before placing an order.
Unless we state otherwise, a quotation is an invitation to place an order and does not itself create a binding contract.
Any quotation may be subject to availability, verification of product compatibility, delivery requirements and any other conditions stated within the quotation.
Where a quotation includes a validity period, the quotation may be accepted only within that period unless we agree otherwise.
4. Orders
An order placed with Squid Ink is an offer to purchase the products or services described in that order.
A binding contract is formed only when we expressly accept your order, confirm that it has been accepted or otherwise begin fulfilling it.
We may decline or cancel an order before acceptance where, for example, a product is unavailable, an obvious pricing error has occurred, compatibility cannot be confirmed or we are unable to process payment.
If payment has already been taken for an order we are unable to accept, we will arrange an appropriate refund.
5. Product descriptions
We take reasonable care to ensure that product descriptions, references and other information supplied to customers are accurate.
However, product packaging, labelling, colour, appearance or specification may occasionally vary from images or descriptions provided by manufacturers or suppliers.
Images shown on the website are illustrative and may not always represent the precise appearance of the product supplied.
6. Printer compatibility
Printer supplies are often model-specific. You are responsible for providing accurate information about your printer, including the manufacturer and model number where compatibility advice is requested.
Where we provide compatibility guidance based on information you supply, that guidance will depend on the accuracy and completeness of the information provided to us.
If you are unsure which ink, toner or consumable you require, we recommend contacting us before ordering so that we can assist with identifying the appropriate product.
7. Prices
Prices will be those confirmed by us at the time an order is accepted.
Unless expressly stated otherwise, prices may exclude delivery charges and any applicable taxes or other charges.
Where VAT is applicable, it will be charged at the prevailing rate and shown where required.
If an obvious pricing error occurs, we are not obliged to supply a product at the incorrect price where the error could reasonably have been recognised as a mistake.
8. Payment
Payment terms will be confirmed at the time of order or within any quotation, invoice or account arrangement agreed with you.
Where payment is required before dispatch, we are not obliged to release or dispatch goods until cleared payment has been received.
Business customers with agreed credit terms must make payment in accordance with the terms stated on the relevant invoice or account agreement.
9. Delivery
Delivery times and dates are estimates unless we expressly agree otherwise in writing.
We will take reasonable steps to dispatch goods within the timeframe communicated to you, but delivery may depend on carriers, suppliers, stock availability and circumstances outside our reasonable control.
You are responsible for providing an accurate and complete delivery address.
If a delivery cannot be completed because incorrect or incomplete information has been provided, additional delivery charges may apply where legally permissible.
10. Risk and ownership
For consumer purchases, risk in the goods passes in accordance with applicable consumer law.
For business customers, unless otherwise agreed in writing, risk in goods passes on delivery.
Where permitted by law, ownership of goods supplied to a business customer will not pass until we have received payment in full for those goods.
11. Consumer rights
If you are purchasing goods as an individual for purposes wholly or mainly outside your trade, business, craft or profession, you may be treated as a consumer under UK law.
Consumers have statutory rights relating to goods, including rights where goods are faulty, not as described or not fit for purpose.
Nothing in these Terms and Conditions is intended to exclude, restrict or replace those statutory rights.
12. Returns and cancellations
If you are a consumer purchasing at a distance, you may have a legal right to cancel certain purchases within the applicable cancellation period.
Any cancellation rights are subject to the exclusions and conditions set out in applicable consumer law.
You should contact us as soon as possible if you wish to cancel or return an order.
Where a return is accepted, goods should be returned in accordance with the instructions we provide and, where appropriate, in a condition that allows us to identify and inspect them.
Nothing in this section limits any right you may have to return faulty, damaged, misdescribed or otherwise non-conforming goods.
13. Faulty, damaged or incorrect goods
If goods arrive damaged, appear faulty or do not match what you ordered, please contact us promptly so that we can investigate.
We may ask you to provide photographs, product references, batch information or other details to help us assess the issue.
Where you are legally entitled to a repair, replacement, refund or other remedy, we will deal with the matter in accordance with applicable law.
14. Business customers
If you purchase from us wholly or mainly for business purposes, the consumer-specific provisions in these Terms and Conditions may not apply to you.
Business customers are expected to inspect goods within a reasonable period following delivery and notify us promptly of any apparent shortage, damage or incorrect supply.
Any separate written supply agreement, credit agreement or commercial terms agreed between Squid Ink and a business customer will take priority where they conflict with these general Terms and Conditions.
15. Our liability
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.
For consumers, our liability is subject to the protections and remedies provided by applicable consumer law.
For business customers, to the extent permitted by law, we will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of opportunity or loss of anticipated savings arising from the supply or use of goods.
Any limitation of liability applicable to business customers will be subject to applicable law and any specific terms agreed in writing between us.
16. Events outside our reasonable control
We will not be responsible for delay or failure to perform an obligation where this is caused by events outside our reasonable control.
This may include disruption to suppliers, carriers, communications networks, utilities, transport systems, industrial action, natural events, government action, import or export restrictions or other comparable events.
We will take reasonable steps to minimise the effect of such circumstances where possible.
17. Website use
We aim to keep this website accurate, secure and available, but we do not guarantee that access will always be uninterrupted or error-free.
We may update, suspend or withdraw parts of the website without notice where reasonably necessary.

Business customers agree that the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms and Conditions, unless otherwise agreed in writing.
